Agreement to Terms

By accessing or using the services provided by Notary On Demand, operated by Notary On Demand LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

Age Restriction

You must be at least 18 years of age to use our services or to consent to receive SMS/text messages from Notary On Demand. By using our services or opting in to receive text messages, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use our services or submit your contact information through any of our forms.

Services Description

Notary On Demand LLC provides mobile notary public services in five U.S. metropolitan areas — Los Angeles, California; Atlanta, Georgia; Chicago, Illinois; Houston, Texas; and New York City, New York — and Remote Online Notarization (RON) for signers located anywhere in the United States, where state law permits. Each notarial act is performed by a notary commissioned by the state in which the notarization takes place, in accordance with that state's notary statute (for example, Florida Statutes Chapter 117 for any act performed under a Florida commission, California Government Code §§ 8200 et seq. for California, Georgia Code Title 45 Chapter 17, 5 ILCS 312 (Illinois Notary Public Act), Texas Government Code Chapter 406, and New York Executive Law Article 6).

Our services include but are not limited to:

  • Acknowledgments
  • Oaths and affirmations
  • Jurats (verification on oath or affirmation)
  • Copy certifications (where permitted by state law)
  • Signature witnessing
  • Loan document signings
  • Remote Online Notarization (RON) via secure audio-video session, where permitted by state law

Notary Limitations

Notary On Demand LLC is not a law firm and does not provide legal advice. Our notaries are notaries public, not attorneys. We cannot:

  • Provide legal advice or explain the legal effect, meaning, or consequences of any document
  • Determine the legal sufficiency, validity, or effect of any document we notarize
  • Draft, prepare, complete, or fill in any legal document for you
  • Recommend or choose which document you should sign or which form is appropriate for your situation
  • Act as your attorney, accountant, real estate agent, immigration consultant, or financial advisor
  • Notarize a document if the signer is not present (in person or, where permitted, via a compliant audio-video session)
  • Notarize a document if the signer cannot be properly identified
  • Notarize a document if the signer appears to be under duress, coercion, or unable to understand what they are signing

Identification Requirements

The notary statute of the state where the notarization is performed requires every signer to present valid, current, government-issued photo identification (or, where the statute allows, satisfactory evidence of identity through credible witnesses). Generally accepted forms of ID include:

  • Valid state-issued driver's license
  • State-issued non-driver identification card
  • United States passport or passport card
  • Foreign passport (with limitations that vary by state)
  • U.S. military ID, permanent resident card, or other government-issued photo ID accepted under the applicable state statute

For Remote Online Notarization, additional identity-proofing steps are required by law and are described in Section 12 below. If you cannot provide proper identification, we will be unable to perform the notarization.

SMS / Text Message Communications

Notary On Demand may communicate with you via SMS/text messaging for service-related and promotional purposes, subject to your consent. Our SMS practices follow the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227) and the CTIA Messaging Principles & Best Practices. The following terms govern our text messaging program.

Description of SMS Use Cases

By opting in, you may receive the following types of text messages from Notary On Demand:

  • Appointment confirmations and reminders
  • Service status updates and notifications
  • Responses to your inquiries
  • Promotional offers, discounts, and marketing communications (only if separately consented to)

Opt-In Consent

SMS consent is collected at the time you submit a contact or scheduling form on our website. Consent to receive transactional messages and consent to receive marketing messages are collected separately. Providing your phone number does not, by itself, constitute consent to receive SMS messages. Your consent to receive SMS messages is never a condition of purchasing our services.

Opt-Out Instructions

You may opt out of receiving SMS messages from Notary On Demand at any time using any of the following methods:

  • Reply STOP to any text message you receive from us. You will receive a one-time confirmation message confirming your opt-out, after which no further messages will be sent.
  • Email us at hello@notaryondemand.com with your opt-out request
  • Call us at +1 310-871-9420 to request removal

Please note: After opting out of marketing messages, you may still receive transactional messages related to active appointments or services already in progress.

Message & Data Rate Disclosure

Message and data rates may apply to all SMS messages sent and received. Message frequency varies based on your service activity and communication preferences. We do not charge separately for text messages, but your mobile carrier's standard messaging and data rates will apply. Contact your mobile carrier for details about your plan.

Carrier Liability Disclaimer

Notary On Demand does not guarantee the delivery of SMS messages. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is outside our control.

Supported Carriers

Our SMS program is supported by most major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carrier participation may vary.

Appointment & Scheduling

Appointments are scheduled based on availability. While we strive to accommodate all requests, appointment times are not guaranteed until confirmed. We reserve the right to reschedule or cancel appointments due to unforeseen circumstances.

Cancellation Policy

If you need to cancel or reschedule a confirmed appointment, please provide at least 2 hours' notice before the scheduled appointment time. Cancellations made with less than 2 hours' notice may be charged a cancellation fee equal to the quoted travel fee. No-shows — where the signer is not present at the agreed location at the agreed time and cannot be reached within 15 minutes — will be charged the full quoted service fee, including travel.

Fees & Payment

Service fees are based on the type of service, the number of notarial acts (signatures, acknowledgments, jurats) required, and travel distance. The maximum per-notarial-act fee is set by the state where the act is performed; any travel, after-hours, weekend, holiday, or printing fees are separately disclosed and quoted before the appointment is confirmed. Payment is due at the time of service.

We accept cash, credit cards, and other electronic payment methods. Additional fees may apply for after-hours, weekend, or holiday appointments.

Travel Fees

Mobile notary services include travel to your location. A travel fee is calculated based on round-trip distance from the notary's service area to the signing location, and is triggered the moment the notary departs for the appointment. Travel fees are quoted and disclosed at the time of booking. If the appointment is cancelled after the notary has departed, or if service must be refused on arrival for any reason listed in Section 10, the travel fee remains payable in full and is non-refundable.

Refusal of Service

We reserve the right, and in many cases are required by the notary statute of the state where the act is performed, to refuse a notarization if any of the following occurs:

  • The signer cannot provide proper, current, government-issued photo identification (or other identification accepted under the applicable state statute)
  • The signer appears to be under duress, coercion, intoxicated, or otherwise impaired
  • The signer does not appear to understand the nature of the document or the act being notarized
  • The signer does not speak a language the notary understands, and no qualified neutral translator is available as required by state law
  • The document is incomplete, contains blank spaces, or has been altered after signing
  • The notarial act would violate the notary statute of the state where the act is performed, or any other applicable law
  • The signer is not personally present (in person, or — for RON — in a compliant audio-video session) at the time of the act

Where service is refused for any of the reasons above, no refund will be provided for travel fees or platform fees already incurred.

Document Preparation

All documents must be complete and ready for signing at the time of the appointment. We do not draft, prepare, complete, or advise on the content of any document. If documents are not ready at the appointment, the appointment may need to be rescheduled and additional fees may apply.

Online / Remote Notarization

Remote Online Notarization ("RON") is a notarial act performed by an authorized notary using two-way audio-video technology, in accordance with the RON statute of the state where the notary is commissioned. We offer RON only through notaries commissioned in states whose laws authorize remote online notarization (for example, Florida, Texas, Virginia, and other RON-enabling states). The act is governed by the law of the notary's commissioning state, regardless of where the signer is physically located.

Identity Proofing & Credential Analysis

For every RON session, the signer must complete the identity-proofing steps required by the applicable state statute. This typically includes (a) credential analysis of a government-issued photo ID using a third-party verification provider, and (b) knowledge-based authentication ("KBA") — answering personal-history questions drawn from public and proprietary data sources within a strict time limit. If the signer cannot complete credential analysis or KBA, the notarization cannot proceed and any platform fee may be non-refundable.

Audio-Video Recording & Retention

Every RON session is recorded as a single, continuous audio-video file. The recording, together with the electronic notarial journal entry, is retained by the notary or the RON platform for the period required by the notary's commissioning state (commonly 5 to 10 years). You consent to this recording as a condition of receiving RON service. The recording may be produced in response to a lawful subpoena, court order, or request by the commissioning state's notary regulator.

Signer Location Rules

You must disclose your physical location at the start of the RON session. The notary may decline to proceed, or may be legally prohibited from proceeding, if (a) the signer is located outside the United States, (b) the document concerns real property in a state that does not recognize out-of-state RON for that document type, or (c) the signer's location otherwise creates a conflict-of-laws issue under the applicable RON statute.

Document-Type Exclusions

Some documents are not eligible for RON in some or all states. Common examples include certain wills and codicils, certain trusts, and some family-law instruments such as adoption and divorce papers. Real-estate documents may have additional county-recorder requirements that effectively require an in-person mobile notary. If your document is not eligible for RON in your state, we will tell you and, where possible, refer you to our in-person mobile notary service in one of our service-area cities.

Liability Limitations

Notary On Demand's liability is limited to the fees paid for the specific notarization in question. We are not liable for:

  • The content, validity, or legal effect of any document notarized
  • Any errors in documents prepared by others
  • Any damages arising from the use of notarized documents
  • Delays or failures due to circumstances beyond our control

Indemnification

You agree to indemnify and hold harmless Notary On Demand, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference and available at our website. Our Privacy Policy governs how we handle your personal data, including mobile opt-in information and SMS consent, which is never sold or shared with third parties for marketing purposes.

Record Keeping

The notary statute of the state where each notarial act is performed governs the journal and recordkeeping requirements for that act. Our notaries maintain a journal of notarial acts (paper or electronic, as authorized by the applicable state) and retain it for the period required by that state's law. For Remote Online Notarizations, the audio-video recording and electronic journal entry are retained as described in Section 12 above.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Notary On Demand and is protected by copyright and trademark laws.

Governing Law

Each notarial act we perform is governed by the notary statute of the state where the act is performed (for in-person mobile notarization, the state where the signer and notary meet; for Remote Online Notarization, the state where the notary is commissioned). These Terms and Conditions, and any non-notarial dispute arising from your use of this website or our services, are governed by the laws of the State of Delaware (the state of incorporation of Notary On Demand LLC), without regard to its conflict-of-laws principles. Any such dispute shall be resolved exclusively in the state or federal courts located in the State of Delaware, except where applicable consumer-protection law gives you the right to bring an action in your state of residence.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
