Agreement to Terms
By accessing or using the services provided by Notary On Demand ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
Services Description
Notary On Demand provides mobile notary public services throughout the State of Florida. Our notaries are commissioned by the State of Florida and authorized to perform notarial acts in accordance with Florida Statutes Chapter 117.
Our services include but are not limited to:
- Acknowledgments
- Oaths and affirmations
- Jurats (verification on oath or affirmation)
- Copy certifications
- Signature witnessing
- Loan document signings
Notary Limitations
Please understand that notaries are not attorneys and cannot provide legal advice. We cannot:
- Provide legal advice or explain the legal effects of documents
- Prepare legal documents
- Recommend what documents you should sign
- Notarize documents if the signer is not present in person
- Notarize documents if the signer cannot be properly identified
- Notarize documents if the signer appears to be under duress or impaired
Identification Requirements
Florida law requires that all signers present valid, government-issued photo identification. Acceptable forms of ID include:
- Valid driver's license
- State-issued identification card
- United States passport
- Foreign passport
- Other government-issued photo ID
If you cannot provide proper identification, we will be unable to perform the notarization.
Appointment and Scheduling
Appointments are scheduled based on availability. While we strive to accommodate all requests, appointment times are not guaranteed until confirmed. We reserve the right to reschedule or cancel appointments due to unforeseen circumstances.
Cancellation Policy
If you need to cancel or reschedule an appointment, please provide at least 2 hours notice. Cancellations with less than 2 hours notice may be subject to a cancellation fee. No-shows will be charged the full service fee.
Fees and Payment
Service fees are based on the type of service, number of signatures required, and travel distance. All fees will be disclosed before the appointment is confirmed. Payment is due at the time of service.
We accept cash, credit cards, and other electronic payment methods. Additional fees may apply for after-hours, weekend, or holiday appointments.
Travel Fees
Mobile notary services include travel to your location. Travel fees are calculated based on distance and may vary by location. Travel fees will be disclosed at the time of booking.
Refusal of Service
We reserve the right to refuse notarization services if:
- The signer cannot provide proper identification
- The signer appears to be under duress, coercion, or impaired
- The signer does not appear to understand the document
- The document appears incomplete, contains blank spaces, or has been altered
- The notarization would violate Florida law or notary standards
- The signer is not physically present
In such cases, no refund will be provided for travel fees already incurred.
Document Preparation
All documents must be complete and ready for signing at the time of the appointment. We do not prepare documents. If documents are not ready, the appointment may need to be rescheduled, and additional fees may apply.
Liability Limitations
Notary On Demand's liability is limited to the fees paid for the specific notarization in question. We are not liable for:
- The content, validity, or legal effect of any document notarized
- Any errors in documents prepared by others
- Any damages arising from the use of notarized documents
- Delays or failures due to circumstances beyond our control
Indemnification
You agree to indemnify and hold harmless Notary On Demand, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.
Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Record Keeping
Florida law requires notaries to maintain a journal of notarial acts. Information from notarizations will be recorded and retained as required by law.
Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Notary On Demand and is protected by copyright and trademark laws.
Governing Law
These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or our services shall be resolved in the courts of Florida.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
